File a Statement of Information: After the Articles of Organization are filed, the Secretary of State requires that you file a Statement of Information. The Statement of Information, includes the business and mailing address of the entity, the names and addresses of the members, the agent for service of process, and a brief description of the business. When we send you the certified (filed) copy of the Articles of Organization, we will include a Statement of Information form. Add this to your order if you would like us to file it for you.
Employer Identification Number: If you would like, we can obtain your EIN for your new Montana LLC. Simply add it to your order or fill out our online EIN order form and we will obtain the EIN within 24-48 hours.

Montana LLC Formation Guidelines
The Limited Liability Company name must contain name must contain the words “limited liability company” or “limited company” or the abbreviations “l.l.c.”, “l.c.”, “llc”, or “lc”. The word “limited” may be abbreviated as “ltd.”, and the word “company” may be abbreviated as “co.”An available name may be reserved for a 120-day period.
The limited liability company can be formed by any one (1)or more persons.
The limited liability company can be formed with one (1)or more members.
The period of duration of a limited liability company is perpetual unless a limited term is stated in the Articles of Organization.
RECORD KEEPING REQUIREMENTS
The limited liability company must maintain an office, which may be but need not be a place of its business in Montana or its registered office, where its records will be kept.
REGISTERED AGENT AND REGISTERED OFFICE
The limited liability company must maintain a registered agent and office to receive service of process in Montana.
The members of a limited liability company may adopt and maintain a separate operating agreement. The agreement may contain any provisions regarding the affairs and conduct of the business of the company to the extent such provisions are not inconsistent with the laws of the Montana or the Articles of Organization.
Submit to the Secretary of State an executed original and one conformed copy of the Articles of Organization.
The Montana Secretary of State annual reports are due every April 15th for the year after you initially file. This means, if you form a Montana company in February, it’s NOT due on April 15th of that year, but the next year. Failure to submit a properly completed Montana Annual Report to the Secretary of State on or before the due date may subject the entity to being administratively dissolved in the state of Montana or having its authority to transact business in the state revoked by the Secretary of State. Penalties may accrue for delinquent Annual Reports.
